Robert,

That is a good pickup. The rule references "joint participation" and not "joint responsibility". While joint participation could attach joint responsibility, it is not explicit that it does, outside of a careful reading, which I had taken.

Comment 7A to the rule, though, seems to indicate that lawyers can decide to be jointly responsible on cases, and that that joint responsibility does not necessarily attach to a joint participation.

In light of your comment, and this review, I've removed the language respecting joint responsibility, because it seems to be an open question, leaning toward a resolution that there is no joint responsibility in the absence of an agreement between lawyers (and signed off on by clients) to that effect.

Thanks very much for your comment.

Jared

What is the authority for "The check on the system is that lawyers are jointly responsible for the representation,"

This is a great post with excellent products selected. I've been down the iPad path and decided that, for now, I prefer the Macbook Air along with tethering on my phone. I can't do some of the things I really need to do do while using the iPad and I found myself carrying the iPad and the Air all the time. By the time you combine your iPad, keyboard and stand, you're heavier than my 13" Air and I've got a bigger screen. I bet we could debate this for hours (serious geeks).

I'm dreaming of the future where the iPad and the Air merge into a laptop with a touchscreen.

I totally agree on the scanner - great choice - and the Jambox. I'm in love with both of those.

I've got a pair of the Jaybirds which are fine, but I'm concluding (after 5 weeks on the road) that I'm probably better off with wired earbuds so I don't have to deal with charging and an extra cable.

You've picked some great Apps and I can't wait to try out the projector. Hunting one down now.

Thanks for the article. Great stuff.

Lee Rosen
DivorceDiscourse.com

I think it is a mistake to do both simultaneously. Search for a job or open a practice. When you make the commitment to start seeking out clients you are immediately elevated to peer in the eyes of your colleagues. You may be a novice, you may need mentors, but you are showing commitment. As Nicole noted in her comment, you are simply treated differently and people will respond accordingly. If you decide you are going to be working 40 hours a week, you may just have one client who requires two hours worth of billable time. The other 38 should be spent marketing, networking, hanging out at courthouses and learning some more. This is when opportunities present themselves and it just might be in the form of more clients as you create your own 'job' rather than waiting for someone to give you one. But commit to one or the other. Dividing your energies is a recipe for failure at both.

I have definitely found that there is a distinct difference to the way people network when you are job searching v. "starting a solo practice". Just those four words have gotten me closer to opportunities than the whole year after graduating. People take you more seriously when you show drive and ambition to go it alone in the face of this economy, and will help however they can (especially with referrals or co-opting projects).
